NETWORKING SUPPLEMENTAL AGREEMENT

(To The NexGenAccess DSL or Wireless Service
Agreement)
READ THIS AGREEMENT
CAREFULLY BEFORE USING THE NexGenAccess HOME NETWORKING SERVICE.
- AGREEMENT
The following terms apply to your use of the NexGenAccess Home Networking
Service (“the Service") in conjunction with your NexGenAccess High
Speed Internet service (Wireless) and the respective agreements as found
on the NexGenAccess Web site at http://www.NexGenAccess.com
- CANCELLATION
To cancel the Service you must call 740-513-4122 or send registered or certified
mail, return receipt requested, to NexGenAccess, Inc., 100 Lake St. Delaware,
Oh 43015. NexGenAccess may terminate this Agreement, your password, your
account, or your use of the Services for any reason, including, without
limitation, if NexGenAccess, in its sole discretion, believes you have violated
the Agreements or if you fail to pay any charges when due.
- EQUIPMENT RETURN POLICY
If you purchased equipment directly from NexGenAccess, the following applies:
All equipment returns must have an NexGenAccess-provided shipping label
and the original packaging (or equivalent). If you cancel your account and
return all equipment within 14 days of your shipping date (the date NexGenAccess
mails and/or installs your equipment), NexGenAccess will refund all fees
incurred to date, excluding postage and handling. NexGenAccess will not
refund any fees after 14 days of your shipping date. NexGenAccess will mail
you a shipping label upon cancellation and will not accept returns without
an NexGenAccess-supplied shipping label.
If
after 14 days of your original shipping date you are dissatisfied with the
Service or any related terms, conditions, rules, policies, guidelines, or
practices, your sole remedy is to discontinue using the Service, cancel your
account, and pay any cancellation fees that apply. Cancellation will be effective
at the end of the current billing period in which notice of cancellation is
received.
NexGenAccess,
in its discretion, may replace equipment due to manufacturer’s defect at no
cost to you under the following circumstances: you call the NexGenAccess Technical
Support Department within one year of your original shipping date; the
NexGenAccess Technical Support Department certifies that a defect has occurred;
and you return the equipment in the original packaging (or equivalent) using an
NexGenAccess-provided shipping label within 30 days of certification. Upon
certification, NexGenAccess will ship replacement equipment to you. Failure to
return the certified equipment within 30 days of certification shall result in
a charge for the new equipment. NexGenAccess will not accept the return of
equipment without NexGenAccess Technical Support Department certification and
shipping label after 30 days from the original shipping date. NexGenAccess will
not replace any equipment, including replacement equipment, after one year from
your original shipping date.
- HARDWARE REQUIREMENTS
For PC: Windows 98SE, Windows 2000, or Windows XP. Server versions
of Windows 2000 are not supported.
For Macintosh: Mac OS 8.0 or higher
- TECHNICAL SUPPORT POLICY
Due to the wide range of hardware and software configurations and
compatibility, it may not be possible for NexGenAccess to provide technical
support for your current set of products. In certain circumstances, it may
be necessary to refer you to the manufacturer of your hardware or software
vendor for technical support of their products. NexGenAccess will use its
best effort to provide support for the following configurations:
- Up to four machines sharing
one broadband connection
- Default network configuration
- Equipment sold or endorsed by
NexGenAccess
- The horizontal range (or
radius of coverage) of up to 75 feet and a vertical range not exceeding
two stories for wireless devices in most situations (your local
radio/microwave interference may inhibit performance, see details below)
NexGenAccess
will not be able to provide technical support for the following:
- Network fax machines or scanners
- Inter-operating-system file sharing
(i.e., does not support NT <-> 9x, 9x <-> MAC, MAC <->
NT)
- "Traveling" network
machines, Local LAN support only (users should record their Home Network
settings for their "traveling" laptops, as settings to use other
networks will usually be different.)
- Internet server support (ftp,
pop, smtp, http)
- VPN or other remote access support
- Interference to a wireless LAN
due to other products transmitting energy in the same frequency range
(i.e., microwaves, multiple wireless LANs, etc.)
- PAYMENT
You agree to pay all charges when due including any activation fees, monthly
payments, and cancellation fees. Prices are subject to change upon 30 days
notice. NexGenAccess may charge for taxes and other applicable fees.
- MOVING
You acknowledge that this is a fixed-location service only. Moving to another
location may result in fees associated with canceling and setting up a new
account.
- Assignment.
NexGenAccess shall be entitled to assign this Agreement either
in whole or in part.
- The User undertakes that he/she
will not assign, re-sell, sub-lease or in any other way transfer his/her
rights or obligations under this Agreement.
